Terms of Service

These terms govern your use of Marlow at app.gomarlow.co (“Marlow”, “we”, “us”), operated by Milo Ghosh GbR (VAT ID DE320399388). By creating an account or using Marlow you agree to them. If you use Marlow for a company, you confirm you can accept these terms on its behalf.

1. The service

Marlow helps you research your audience and competitors: it gathers public market data, analyses it with AI, and, if you choose, analyses content from tools you connect. Marlow is currently in beta. Features, limits and availability may change, and access may depend on a promo code, a number of projects per account, or a time-limited data window.

You keep all rights to the content you add or connect. You give us permission to store and process it only to provide Marlow to you, as described in our Privacy Policy. Marlow only reads from the tools you connect; it never changes anything in them.

5. Results and AI

Marlow’s analyses rely on third-party data and AI models. They can be incomplete, out of date or wrong. Treat them as input to your own judgement, not as professional advice, and check anything important before acting on it.

6. Third-party services

Marlow relies on outside services for data, AI, hosting and sign-in. Their availability and terms are outside our control, and a feature may change or stop if a provider changes its service.

7. Fees

The beta is currently free. If we introduce paid plans, we will tell you in advance, and nothing will be charged without your agreement.

8. Suspension and closing your account

You can stop using Marlow and ask us to delete your account at any time. We may suspend or close an account that breaks these terms or puts Marlow or other users at risk, and we may end the beta. Where reasonable we will give notice so you can view your results first.

9. Disclaimers

Marlow is provided “as is” and “as available”. To the extent the law allows, we make no warranties that it will be uninterrupted, error-free or fit for a particular purpose.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, revenue or data. Our total liability for any claim relating to Marlow is limited to the amount you paid us in the 12 months before the claim, or €100 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.

11. Changes to these terms

We may update these terms. If a change is significant we will tell you by email or in the app before it takes effect. Continuing to use Marlow after that means you accept the new terms.

12. Governing law and courts

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you use Marlow as a consumer, you keep the protection of the mandatory laws of the country where you live.

If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from these terms is Berlin-Charlottenburg (Amtsgericht Charlottenburg, or the higher court competent for it). Consumers may bring or face claims in the courts where the law allows.
